Terms of Use

These Terms of Use ("Terms") govern your use of the Locked In mobile application (the "App") and the website at gettinglockedin.com (the "Site"), provided by Promote Yourself Inc ("Locked In," "we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You may use Locked In if you are at least 13 years old, or if you have permission from a parent or legal guardian to use the App. The App is intended to comply with applicable laws regarding minors.
2. Service description
Locked In provides guided mental performance sessions for softball players, including breathing exercises, visualization, and affirmations. Locked In is for educational and personal training purposes only. It is not intended as medical, psychological, or therapeutic advice. If you are experiencing distress or have a mental health concern, please consult a qualified professional.
3. Subscription
Locked In is free to download. Some features are available only with a paid subscription ("Locked In Pro"):
- Locked In Pro Monthly: $4.99 per month
- Locked In Pro Annual: $44.99 per year (saves $14.89 versus paying monthly for a year)
Free trial. When you complete onboarding, the App grants you a 3-day free trial of full features. The trial does not require payment information and is granted automatically by the App, not by Apple. After the trial ends, you may purchase a subscription to retain access to paid features. The trial is non-renewable and is offered once per device.
Billing. Subscriptions are sold and billed by Apple through your Apple ID. Payment is charged to your Apple ID at confirmation of purchase. We never receive your payment card information.
Auto-renewal. Your subscription automatically renews at the end of each billing period unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate in effect at that time.
Managing your subscription. You can manage and cancel your subscription at any time in your Apple ID Account Settings on your device. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then.
Refunds. All subscriptions are sold and refunded by Apple. Refund requests must be submitted to Apple at reportaproblem.apple.com. We are unable to issue refunds directly.
Price changes. If we change the price of a subscription, we will notify you in advance. Continued use of the subscription after the change takes effect constitutes acceptance of the new price. You may cancel before the change takes effect to avoid the new price.
4. License grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use, subject to these Terms and the Apple Media Services Terms and Conditions. You may not:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App to violate any law
- Resell, sublicense, or otherwise transfer access to the App or its paid features
- Use the App or its content to develop a competing product
5. User conduct
You agree to use Locked In only for its intended purpose. You may not use the App in any way that could harm, disable, or impair the App or the experience of other users.
6. Intellectual property
All content in the App, including audio, text, visual design, and the Locked In name and logo, is owned by Promote Yourself Inc or its licensors and is protected by copyright, trademark, and other laws. Nothing in these Terms transfers any ownership of this content to you.
7. Health and wellness disclaimer
Locked In is a mental performance training tool. It is not a medical device, psychological treatment, or substitute for professional mental health care. The App's content is provided for general educational and personal training purposes only. If you have a medical or mental health condition, consult a qualified professional. If you are in crisis, contact emergency services or a crisis hotline.
8. Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected.
9. Limitation of liability
To the fullest extent permitted by law, Promote Yourself Inc and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the App. Our total liability to you for any claim arising out of these Terms or your use of the App is limited to the amount you paid us in the twelve months preceding the claim, or fifty US dollars, whichever is greater.
Some jurisdictions do not allow the limitation or exclusion of certain warranties or liability for incidental or consequential damages, so the above limitations may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Promote Yourself Inc from any claims, damages, losses, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another.
11. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any reason. You may stop using the App at any time. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute provisions) will survive.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the App will be resolved in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms at this URL with a new "Last updated" date. If the changes are material, we will provide additional notice through the App. Continued use of the App after the change takes effect constitutes acceptance of the updated Terms.
14. Apple-specific terms
You acknowledge that:
- These Terms are between you and Promote Yourself Inc, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation.
- We, not Apple, are responsible for addressing any claims relating to the App.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
